Definitions
Royal County Wedding Cars, We, Us, Our - Refer to Royal County Wedding Cars, its partners Andrew Burns and Kim Burns and/or employees, providing UK Wedding Car and Wedding Transport services.
You, Your, Client, Clients, Hirer, Hirers - Refer to the person/s making the booking and who enters into a contract directly with Royal County Wedding Cars.
Vehicle, Vehicles means any motor car(s) Royal County Wedding Cars uses for carrying out services.
Services means bespoke chauffeur driven wedding transportation provided by Royal County Wedding Cars.
Booking means the reaching of agreement between Royal County Wedding Cars and the Client.
Event means day(s) agreed for services to be provided for a wedding, blessing or civil partnership.
Driver means a partner or employee representing Royal County Wedding Cars, driving a Vehicle to provide Services.
General
These terms and conditions constitute the entire agreement between the parties and supersede any previous agreement or understanding and may not be varied except in writing between the parties. All other terms and conditions expressly implied by statute or otherwise, are excluded to the fullest extent permitted by law.
These terms & conditions shall be governed by and construed exclusively in accordance with English law. The Courts of England shall have exclusive jurisdiction in all matters relating to them.
Royal County Wedding Cars reserves the right to change these terms and conditions at any time without prior notice. If any changes are made, the revised terms and conditions of vehicle hire shall be posted online immediately.
Payments
Deposit Payment - The initial Deposit Payment is payable by the Client at time of confirming their Booking. The Deposit Payment ensures the Vehicle is reserved for the Client and removed from availability to others on the date of the Event. The booking is not confirmed until receipt of the Deposit Payment. Upon receipt of the Deposit Payment a contract is formed between Royal County Wedding Cars and the Client. These Terms and Conditions are incorporated in all contracts.
Balance Payment - This final balance payment is due 30 days prior to the Event. If payment is not received on or before that date the Booking will automatically be deemed a Cancellation by Client and all monies paid will be forfeited and Royal County Wedding Cars reserves the right to pursue the outstanding balance via their dedicated collection agency. Vehicles will not be provided unless the full balance has been received. It is the Client’s responsibility to ensure the balance is paid on time.
Full Payment – Any bookings made within 30 days of the Event will require payment in full. The Booking will not be confirmed until receipt of Full Payment.
Confirmation and Changes to Services
Booking Confirmation – Upon receipt of the deposit payment, Royal County Wedding cars will provide by email a Booking Confirmation, with details of the itinerary for the Event. It is the Client’s responsibility to check their Booking Confirmation to ensure it accurately details their full requirements.
Changes to Itinerary – Changes to the itinerary such as timings, addresses, additional trips or a photo stop-off meaning an extension to the hire must be requested in writing. An updated Booking Confirmation will be sent to confirm acceptance of the changes. Any additional hire cost following changes to the itinerary will be communicated to the Client prior to updating the Booking Confirmation. Changes by the Client not acceptable to the Royal County Wedding Cars will be deemed as a Cancellation by Client.
Venue Access – Clients must advise at the time of booking of any concerns about access to any venue and if any part of their journey is not over a standard road surface for assessment of vehicle suitability. Your Driver reserves the right on the day not to take vehicles along unsuitable road surfaces if damage to the vehicles bodywork or its underside could be caused.
Clients accept the Driver will do their best to reach all points in the itinerary as closely as possible but some unexpected road diversions or obstructions such as vehicles parked either side of the road may force the Driver to abandon the remainder of the planned route in which case it is agreed that the Driver will take the vehicle to the nearest readily accessible point for passengers to be collected or disembarked. Royal County Wedding Cars cannot be held responsible for delays resulting from unexpected diversions and obstructions.
It is the Client’s responsibility to ensure that any permissions, permits or passes required have been obtained and provided to Royal County Wedding Cars in order to enter private areas, sensitive military areas, private parking or private roads and to remain thereon. Any Driver’s ID checks must be communicated in advance.
Extending Hire Time – Extending the hire beyond that shown on your itinerary is unable to be guaranteed if requested on the actual day. Any agreed extension to timings made on the day with the Driver must be paid in cash. Without a cash payment being made on the day prior to extending the hire time the contract will be deemed as fully completed and ended at the time shown on the Booking confirmation. Extension costs are shown on the Booking confirmation.
Delay to Arrival at Collection Address – In the event a vehicle is en-route to a collection address and encounters a problem which could result in a delay to the scheduled arrival at the collection address the Driver will immediately contact the Client to inform them of the approximate arrival time (mobile signal permitting and mobile driving laws obeyed).
End of Hire – The End of Hire occurs when the vehicle and its occupants have arrived safely at the final destination with no further trips planned and photos with the vehicle completed, or the vehicle has reached the hire end time shown in the Booking Confirmation. The Booking will be concluded, and contract deemed to be completed at the End of Hire.
Change of Event – Changing a wedding date after a Booking has been confirmed is deemed a Cancellation by Client unless Royal County Wedding Cars agrees to changing the date. Any agreed changes to dates will be confirmed via email with an updated Booking Confirmation.
Safety and Damage
Seat Belts - Seat Belts must be worn where fitted. UK law requires all persons to wear seat belts in vehicles where fitted unless you have been given a Certificate of Exemption from Compulsory Seat Belt Wearing. For the avoidance of doubt Royal County Wedding Cars will not be responsible for any injury or damage attributable to a passenger’s failure to wear a seatbelt and the Client shall fully indemnify and keep fully indemnified Royal County Wedding Cars in respect of any losses, demands, expenses, actions, claims or costs arising as a result of a passenger failing to wear a seatbelt.
Child Seat Belts, Car Seats & Safety - The Client must advise at time of Booking if a child using any vehicle will be under 14 years of age on the proposed travel date stating their age at the date of travel. At least one adult member 18yrs + of the wedding party must accompany children when travelling.
Wedding Vehicles are not considered as Licenced Taxis so Clients/Parents/Guardians must be familiar with the Seat Belt Law. Visit the Child Car Seat Government Website for more information and latest changes. Clients/Parents/Guardians must provide the correct child car seat or child restraint for any children who are under 12 years old or less than 135 cm tall. The Driver has the ultimate responsibility and final say as to whether a child travels in their vehicle if there are any doubts as to the restraint the Client has provided.
Vehicle Seating Capacity - Vehicles are not allowed by law to carry more persons than the vehicle manufacturer’s seating capacity. It is the Client’s responsibility to ensure seating arrangements are correct for their needs and passenger’s comfort and style of clothing are taken into consideration.
Safe Driving - The Driver will drive at a safe and sensible driving speed in accordance with road conditions and legal speed limits. Royal County Wedding Cars will not be liable for any delay or for any consequential loss for damages, costs, expenses or other claim for consequential compensation whatsoever.
Smoking, Food & Drinks in Vehicles - The UK prohibits smoking in vehicles used by the public. Smoking is not allowed in any Vehicle, including electronic type smoking devices. Food & drinks must not be consumed inside the Vehicle except drinking water provided by Us.
Night-time Driving - Wedding ribbons can cause visibility problems obstructing the view of the road when driving after dark. The Driver will make the decision whether to drive their vehicle with ribbons during darkness hours taking into consideration passengers’ safety.
Contents - It is the Client’s responsibility to ensure they collect their luggage & personal items when leaving the Vehicle. Royal County Wedding Cars do not accept liability for items left in Vehicles or the responsibility for forwarding on such items.
Clothing Damage - It is the responsibility of the wearer to ensure their clothing avoids close proximity or contact with Vehicle areas that naturally could produce dirt or grease such as the tyres, exhaust pipes, door shuts/hinges etc. Royal County Wedding Cars will not be held liable for soiled or damaged clothing.
Conduct – The Driver retains the right to refuse to convey any passenger who in their opinion appears to be under the influence of alcohol or other substance and whose condition may put the Driver, the Vehicle or other passengers at risk. Abusive or offensive behaviour towards the Driver is not acceptable. In such situations the Driver reserves the right to terminate the hire and Royal County Wedding Cars reserves the right not to make refunds.
Vehicle’s Damage - The Client is responsible for any damage to the vehicle exterior and interior during the hire caused by their own, the bridal party or their guest’s actions. Damage also includes, but is not limited to, that caused by clothing studs, zips or sequins, handbags, cameras, diamond rings, military swords etc. In event of passenger illness in the vehicle the cost of a valet and any time out of service may be charged.
Cancellation and Refunds
Cancellation by Royal County Wedding Cars - If for any reason we are unable to provide the contracted Services we will contact the Client immediately and provide a full refund of all monies paid. For the avoidance of doubt Royal County Wedding Cars will not be liable for any other consequential loss for damages, costs, expenses or other claims for consequential compensation whatsoever. Client agrees that reimbursement and compensation will not exceed a full refund of the total amount the Client paid for the Services.
Cancellation by Client - The Client reserves the right to cancel their Booking at any time. Booking cancellations must be made in writing by email. The Deposit Payment is non-refundable and non-transferable. If cancellation is advised 30 days or less prior to the Event then Full Payment will be due and no amounts refunded.
Cancellation due to un-acceptable changes to Itinerary - The Deposit Payment is not refunded, and this will be forfeited by the Client. If the change is advised 30 days or less prior to the Event then Full Payment will be due and no amounts refunded. Unacceptable changes could include vastly increased mileages, times changed to unsociable hours, etc.
Cancelling or Postponement due to “Force Majeure” – If the government, local authorities and/or official governing bodies issues a ban on weddings for the date of the Event due to “Force Majeure” for such reason as, but not limited to, war, terrorism, earthquakes, hurricanes, acts of government, plagues, pandemics or epidemics this is neither the fault of the Client or Royal County Wedding Cars. In this case, Royal County Wedding Cars will allow for any payments made to be transferred to a Booking for a different date. Any changes to the total cost of hire will be communicated at the time of change or if an alternative date cannot be agreed a full refund will be provided. No cancellation charges will be made.
Weather Related Cancellations & Refunds - In event of very severe weather causing hazardous driving conditions and the Driver deems there a risk to the Vehicle and/or passenger safety, Royal County Wedding Cars reserve the right to cancel the booking. In this event a refund of all payments received will be made to the Client. Passenger safety will always be paramount in any decision taken by the Driver.
Breakdown or unavailability of the Vehicle(s)
Vehicle unavailability due to breakdown, repairs and/or unplanned maintenance – Our Vehicles are maintained to the very highest standards. In the unlikely event that the booked Vehicle suffers breakdown or accident, or other circumstances arise which prevent the Services being provided, we will immediately inform the Client of the situation and offer to help them source an alternative supplier for their Event and provide a full refund of all monies paid.
Breakdown on the day of the Event- For vehicles that experience a breakdown/failure during the actual Event, a reimbursement will be made which depending on the circumstances, may be proportionate. We will consider any trip/s containing passengers that were already completed or partly carried out prior to the problem occurring. Reimbursement or compensation claims will not exceed a full refund of the total amount the Client paid for the Services. The Client agrees to make no further claims in the above-described circumstances.
Insurance and Liabilities
Royal County Wedding Cars maintains adequate insurance in respect of its vehicles and associated public liability in relation to the provision of chauffeur Services with a reputable insurance company against all insurance liability of such and account as shall be determined by Royal County Wedding Cars.
Except in respect of death or personal injury caused by Royal County Wedding Cars negligence Royal County Wedding Cars shall not be liable to the Client by reason of any representation (unless fraudulent), or any other implied warranty, condition or other term, or any duty, common law or under the express terms of the contract, for any loss of profit or any indirect, special or consequential loss, damage cost, expenses or other claims (whether caused by the negligence of Royal County Wedding Cars, its servants or otherwise) including without limitation loss of anticipated profits, goodwill, reputation, business receipts or contracts or losses or expenses resulting from third party claims which arise out of or in connection with the provision of the services or their use by the Client, and the entire liability of Royal County Wedding Cars under or in connection with the contract whether for negligence, breach of contract, misrepresentation or otherwise shall not in any circumstances exceed the amount of Royal County Wedding Cars charges for the provision of the services.
Royal County Wedding Cars shall not be liable to the Client under the above clause or any other clause unless a claim in writing by email is received by Royal County Wedding Cars within 14 days from the date of Royal County Wedding Cars providing the Services to the Client.
